Terms of Service

1. Agreement
By accessing or using the Pathways platform at pathways.id ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legal agreement between you and Pathways Rugby Ltd ("Pathways", "we", "us").
2. Eligibility
You must be at least 18 years old or have the consent of a parent or guardian to create an account. By creating an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date.
Notify us immediately at privacy@pathways.id if you suspect unauthorized access to your account.
4. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose
- Enter false, misleading, or fabricated player evaluation data
- Access or attempt to access data belonging to other organizations without authorization
- Interfere with or disrupt the Platform or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use automated scripts, bots, or scrapers to access the Platform
- Share your account credentials with unauthorized individuals
- Upload malicious files, code, or content
5. Player data and consent
When you enter data about players (including minors), you represent and warrant that:
- You have the authority within your organization to collect and process this data
- For minor players (under 18), appropriate parental or guardian consent has been obtained in compliance with COPPA and applicable state privacy laws
- The data you enter is accurate to the best of your knowledge
- You will use evaluation data for legitimate player development purposes
- You have informed parents or guardians that evaluation data may be visible to other verified organizations where the player is on their roster, if parental portability consent is granted
Pathways acts as a data processor on behalf of your organization. Your organization is the data controller and is responsible for compliance with all applicable data protection laws, including COPPA, CCPA, and any state-specific privacy statutes.
6. Your content and indemnification
You retain ownership of all data you enter into the Platform, including evaluations, player profiles, session plans, and play designs. By using the Platform, you grant us a limited license to store, process, and display this data solely to provide the Pathways service to you and your organization.
We will not access, use, or share your data for any purpose other than providing and improving the Platform, unless required by law.
You agree to indemnify and hold harmless Pathways Rugby Ltd, its officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, including but not limited to: failure to obtain required parental or guardian consent, entry of false or misleading evaluation data, or unauthorized sharing of data accessed through the Platform.
7. Pathways ID and portability
Each player registered on the Platform receives a unique Pathways ID. This identifier is designed to be portable across organizations, allowing a player's evaluation history to follow them through different levels of the sport.
Cross-organization data sharing is governed by parental consent (for minors), organization verification status, and visibility controls within the Platform. When portability is enabled, standardized evaluation scores may be visible to other verified organizations where the player is on their roster. Coach notes and AI-generated insights are never shared across organizations.
8. Data integrity
Submitted evaluations are sealed with SHA-256 cryptographic hashes upon submission. Each evaluation chains to the previous one in the player's history, creating a tamper-evident record that cannot be altered, deleted, or backdated after submission.
By using the Platform, you acknowledge and accept that:
- Evaluation immutability is a core feature of the Platform designed to ensure data trust
- Submitted evaluation scores cannot be altered or removed after submission
- Players or their guardians may attach context annotations to evaluations, but the underlying scores remain permanent
- Coach notes and AI-generated insights remain private to the authoring organization
9. Service availability
We aim to provide reliable, continuous access to the Platform but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We will provide reasonable notice of planned downtime when possible.
10. Limitation of liability
To the maximum extent permitted by law, Pathways shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
The Platform is provided "as is" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy of player evaluations, or suitability for selection decisions. Pathways is not liable for the content of evaluations submitted by organizations and does not guarantee the accuracy or fairness of evaluation data.
11. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms, with or without notice. Upon termination, your right to use the Platform ceases immediately. We will retain your data in accordance with our Privacy Policy.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated via the Platform or by email at least 14 days before taking effect. Continued use after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Pathways Rugby Ltd is incorporated. Any disputes arising from these Terms shall be resolved through good-faith negotiation before pursuing formal legal action.
